So the only actual similarity is the colour! Bonkers, and should be thrown out immediately. They look completely different so the only similarity is the colour. I suspect it's a way of advertising and has no actual merit. I'm sure any headphone maker could sue any other maker due to actual physical similarity except it's now generic - how else can you make headphones? A pathetic move by David Clark Co. I think I may write and tell them so.

Mark:so for a $400 filling fee Dave Clark has plenty of free advertising .... this annoys me like those companies who buy up patents then go around suing manufactures... hopefully the judge will recommend he gets out more..

Pretty well what I said in an e-mail to the David Clark Company. An almost free publicity stunt. I don't suppose I'll get a reply or if I do it will be along the lines of 'we take our products and innovation seriously and will pursue anyone who infringes our trademark of the colour green' etc etc.

I believe I read that Tiffany patented the Pantone reference colour of their minty green blue :) All bizarre!
IANAL but frivolous lawsuits should carry with them mandatory punitive damages. Maybe get B&O some more money for having to deal with this insanity.
Their headphone design doesn't look very good does it ? Perhaps they sound good instead but even the arms holding the speaker differ from the office-chair mono-arm of the B&O that " copied" it.

As I was opening the link, I thought to myself that the conflict must be technical, perhaps patent related for noise control etc. Oh how I laughed when I read it was about the H2 and its color!
If the pale green is a popular color, DC better watch their backs.. Another Danish company will pull seniority when it comes to the color's use.
